GENERAL AND SPECIFIC TERMS AND CONDITIONS OF SALE AND RESERVATION 2016
(Read carefully)
1-Booking : all bookings for treks and tours are handled by Himalayan Frontiers, referred to below as the "company".
1.1-The person signing this document accepts these conditions and refers below to the term "client".
2- Booking a trip: To book a stay, please complete and sign the booking form, then send it to the company by mail or email, along with a 30% deposit of the total amount via bank transfer or online payment at www.himalayanfrontiers.fr. We will then confirm your booking in writing. The remaining balance must be paid 30 days before departure.
3-Bank fees: When paying by bank transfer or credit card, any fees resulting from your bank's terms and conditions and online payment will be your responsibility.
4-Cancellation: In case of cancellation, it must be in writing and signed by the person who completed the booking form. It will be effective upon receipt by the company.
4.1 - 60 days or more before departure: the company will reimburse the client in full, less a processing fee (€40 per person, or the equivalent in other currencies) and bank charges, depending on the bank. For domestic flights, the company will deduct cancellation fees or the total ticket cost, according to the airline's terms and conditions. Hotels are booked and must be paid for in advance: the company will apply the hotel's cancellation policy. Furthermore, it will also deduct cancellation fees for train tickets and any other ground transportation, as well as related services if advance booking is required. Before reimbursement, the original amount will therefore be reduced by the cancellation fees associated with the various booked services.
4.2 - 40 days before departure: the company will be obligated to reimburse 50% of the amount to its client, deducting the processing fee (€40 per person, or the equivalent in other currencies) and bank charges, depending on the bank. For domestic flights, the company will deduct cancellation fees or the total ticket cost, according to the airline's current terms and conditions. Hotels are booked and must be paid for in advance: the company will therefore apply the hotels' cancellation policies. Furthermore, it will also deduct cancellation fees for train tickets and any other ground transportation, as well as related services if advance booking is required. Before the refund, the original amount will therefore be reduced by the cancellation fees associated with the various booked services.
4.3 - Less than 30 days before departure: the company will be obligated to retain the full amount paid by the client. In this case, the client must inform their insurance company as soon as possible and gather the necessary documents to process the trip cancellation claim. Therefore, it is strongly advised to purchase cancellation insurance to protect against this type of problem.
5- Supplements for modification of reserved services: Please note that any modification of the reserved services will incur additional charges.
Before departure or during the trip, any changes or replacements to a confirmed hotel, flight, train ticket, or other travel-related service reservation will be subject to additional charges payable by the customer. For any cancellations or changes prior to the trip, please refer to the booking terms and conditions.
6-Price: All prices quoted are valid for 8 days after the price quote is sent. After this period, prices are subject to change due to currency fluctuations or flight price changes.
6.1 - All prices may vary depending on currency fluctuations until the balance is paid. If, between the time you book (when the company receives the 30% advance payment) and the time you arrive in India, there is an exchange rate fluctuation of more than 2% in the euro/rupee/dollar or any other currency, the company reserves the right to adjust its price accordingly.
7- Liability: The company cannot be held liable for consequences related to weather conditions, flight cancellations, wars or threats of civil war, strikes, industrial action, political upheaval, and any other event of force majeure in unusual and exceptional circumstances. The company reserves the right to change, for example, an itinerary or means of transport in the event of a breakdown, illness, or any other event of force majeure. All resulting additional costs, such as hotels or transportation, will be your responsibility and must be paid immediately.
7-1: Please bear in mind that unforeseen events are always possible during your cultural or adventure trips. The company will not be held responsible for illnesses, injuries (minor or serious), or any death that may occur during the trip, nor for any losses incurred during your stay.
Customers are therefore strongly advised to take out insurance that can cover these unforeseen events and any potential cancellation fees.
8- Travel insurance: This is mandatory for all clients traveling on one of our tours, treks, or itineraries organized by us. You are responsible for obtaining adequate insurance covering the expenses and unforeseen events detailed in paragraph 6: lost luggage, medical expenses, helicopter rescue, injury, death, repatriation, cancellation or shortening of the itinerary.
(8-1) Are these expenses reimbursed by your insurance?
Please consult your insurer to find out if you are reimbursed for expenses related to political unrest, a threat of civil war, a terrorist threat, an earthquake, a fire, a train or flight cancellation or delay, or any other circumstance not covered by your insurance. In such cases, it is advisable to take out supplementary insurance to cover these expenses.
9-Passport, visa and vaccination: all clients must possess a valid passport, a valid visa and a vaccination certificate appropriate to the departure destination.
10-Company rights: The company reserves the right to modify certain details of its services such as accommodation, itinerary or means of transport if it deems it necessary, reasonable or advisable.
11- Refund Policy : In the event of cancellation of your trip, in accordance with the terms and conditions in effect at the time of booking, we will refund the deposit paid for the reservation or, if payment has been made in full, less applicable taxes such as VAT, bank charges, processing fees, and other applicable taxes and fees. For international clients, exchange fees will be adjusted to the prevailing rate.
11-1- For international participants, additional fees will be charged for currency exchange (these fees are the responsibility of the client), bank transfers, and other administrative formalities, which constitutes a lengthy and cumbersome process. We thank you for your understanding and cooperation. We will do our best to handle these cases in accordance with the current circumstances.
11-2- To avoid all these administrative procedures, we ask our clients to postpone their trip. To those who accept, we offer a voucher equivalent to the remaining amount, deducting the cancellation fee in accordance with our cancellation policies. Please note that the price of the postponed trip is subject to change due to economic fluctuations, tax increases, local living conditions, and if the transport association (land or air), hotels, porters, guides, muleteers, and other related service providers increase their prices for services rendered to clients during the trek/tours. As their decision is unavoidable and considered legitimate, we ask clients to take this into account.
11-3- No refund will be issued if a service offered has not been used. Similarly, no refund will be given to a client who voluntarily or involuntarily leaves the trip, or who is forced to leave or abandon the trip due to disruptive behavior towards other participants en route. In such cases, clients will be accompanied (or provided with minimal assistance) to the nearest town (destination) to facilitate their subsequent journey home. In such circumstances, the client will be responsible for any additional expenses incurred, such as escort, transportation, hotels, and other related services, as a result of these circumstances. Himalayan Frontier disclaims all liability once the client leaves the trip, in accordance with the terms and conditions signed prior to departure.
11-4 - Any person who leaves the trip due to inappropriate behavior towards other group participants, staff members (team leader), and the local community, and who does not wish to use the additional services (assistance at their own expense) offered by the company to travel to the nearest town to obtain the necessary services to continue their trip, must submit a letter of withdrawal. This letter confirms that the person is leaving the trip of their own volition and will not be entitled to any refund. In the event of any problem arising after their departure, they will be solely responsible for any incident until their return home, will waive any legal action against the company, and will forfeit their right to a refund.
11-5- Due to their disruptive behavior, if the safety of the group/personnel is deemed compromised by mental, moral, or physical harassment, or if they disrespect and criticize local culture in a way that harms the feelings and pride of the communities, such problems may be governed and interpreted in accordance with local law. If the individual concerned fails to comply with legal procedures and leaves the area/country without completing the required formalities, they will be considered a fugitive and may be apprehended locally/at the airport, or even denied entry to the territory in question.
Please note that Himalayan Frontiers will not intervene in this legal proceeding. Anyone found guilty will be subject to penalties under the Indian Penal Code. All costs incurred in this proceeding will be borne by the found guilty client(s) and must be paid immediately.
12-Decision of the guide or tour manager: The client agrees to accept the directives of the tour manager or guide while traveling under the company's services. If, in the opinion of the tour manager or guide, the behavior of one or more clients is detrimental to the safety, well-being, or harmony of all participants, that client(s) may be asked to leave the trek/tour without a refund and with all additional expenses at their own expense.
13-Modifications to the terms and conditions of reservation:
these conditions may be adjusted within a certain limit, due to special circumstances, by a letter from the company director.
14-Jurisdiction: The contract between the company, clients and third parties is governed and expressed under the jurisdiction of the Criminal Court of Manali (India).
15-Compliance with general and specific terms and conditions of sale and booking: when the customer books a trip it is understood that he reads, understands and accepts the general and specific terms and conditions of sale and booking.
